California Legal Malpractice: Attorney Standard of Care, Causation, and Deadlines

Legal malpractice is professional negligence by an attorney. In California, the elements mirror other professional negligence claims: (1) a duty to use the skill, prudence, and diligence other lawyers commonly possess and exercise, (2) a breach of that duty, (3) a proximate causal connection between the negligent conduct and the injury, and (4) actual loss or damage. An attorney is negligent if they fail to use the skill and care a reasonably careful attorney would use in similar circumstances—the professional “standard of care.”

Lawyers who hold themselves out as specialists are measured against other specialists of ordinary skill in that field. Expert testimony usually defines the standard of care, except where negligence is obvious to a layperson. California instructions also recognize that attorneys need not guarantee success, that reasonable lawyers may choose among alternative strategies, and that referral to a legal specialist may be required when a matter exceeds the lawyer’s competence.

Causation in legal malpractice is often called the “case within a case.” The client must show that, but for the attorney’s negligence, they would have obtained a better result in the underlying matter—such as winning a claim that was lost, recovering more damages, or avoiding a judgment. Typical fact patterns include missed statutes of limitations, failure to investigate or evaluate claims, negligent advice, drafting errors, conflicts of interest, and mishandling of litigation or settlement. When malpractice allegedly caused a criminal conviction, California law imposes additional requirements, including proof of actual innocence.

Deadlines for attorney malpractice are strict. Under Code of Civil Procedure § 340.6, actions generally must be commenced within one year after the plaintiff discovers (or through reasonable diligence should have discovered) the facts of the wrongful act or omission, and in any event within four years from the date of the wrongful act or omission—subject to tolling for continued representation on the same subject matter, actual injury that has not yet occurred, or certain disabilities. Waiting can permanently bar an otherwise valid claim.
